Moii Terms of Use

This agreement

These Terms of Use are the agreement between you and Moii when you use the Moii app. By creating an account you accept them.

The Official Rules and the Privacy Policy form part of this agreement. Where the Official Rules describe how auctions work in more detail, they apply.

What Moii is

Moii is a lowest unique bid marketplace for physical products. You pay a fixed Bid Service Fee to submit one private whole-number bid to an auction. When the auction closes, the lowest number submitted by exactly one participant wins the opportunity to purchase that product at that amount.

The bid amount is not charged when you submit it. Only the winner pays their bid amount, and only after the result is verified.

Eligibility

You must be 18 or older and live in Ethiopia, and you must be able to enter a binding agreement. You declare your date of birth and your country of residence when you set up your account; these are your own declarations, and we do not check identity documents or use your location.

You may hold one account. Creating or controlling more than one account to submit additional bids to the same auction is a breach of these terms.

Your account

You sign in with a phone number we verify by one-time code, or with Apple or Google. You are responsible for keeping access to that phone number and those accounts secure, and for everything done through your account.

We ask for your real name once, so a prize can be delivered to a person. We do not ask for identity documents, and we do not collect any government identifier or biometric data.

Tell us promptly at support@moiiauctions.com if you believe someone else has used your account, and we will end its sessions. You can sign out of this device from Profile.

Information you give us

Information you give us must be truthful and current. Giving false eligibility information or false delivery details may lead to disqualification, suspension of your account, or forfeiture of a prize. A bid that has already been accepted stays in its auction.

Bids and fees

A bid is a positive whole number within the range the auction states. Each bid costs one Bid Service Fee. You cannot submit the same number twice in one auction.

The fee is set by us and shown on the auction before you pay. The amount charged is always the amount our records hold for that auction — the app cannot propose a different one.

Submitting a bid, and paying its fee, does not mean you have won anything. The outcome is not known until the auction closes.

Payments

Payments are taken through our payment provider's secure hosted checkout. Your card number and any mobile-money PIN are entered on the provider's own page. We never receive, see or store them.

A payment is accepted only when Moii has independently verified it with the provider. A browser redirect, a callback, or a message from the provider is not by itself treated as proof — we confirm every payment directly before accepting a bid.

If a payment fails or is cancelled, no bid is submitted and no fee is charged. If a payment is verified after the auction has closed, it is refunded and no bid is accepted.

Refunds

We refund every Bid Service Fee paid to an auction that we cancel before it closes, a payment that is verified after its auction has already closed, and a payment whose bid cannot be accepted. Refunds are made in full through Chapa.

Bid Service Fees are otherwise not refundable, because the fee pays for a bid attempt and that attempt was submitted and counted. This includes an auction that ends with no unique bid.

Nothing in this section limits any right you have under applicable Ethiopian consumer law.

If you win

Winning gives you the opportunity to buy the product at your winning bid amount. You confirm your details and pay the winning bid amount within the deadline stated on that auction. If you do not, the prize is forfeited and is not offered to anyone else.

We deliver to an address in Ethiopia, or hold the product for collection in Ethiopia, after the winning amount is paid. If the exact product has become unavailable we will either supply an equivalent of the same or better specification with your agreement, or refund the winning amount in full.

Chargebacks

If you dispute a payment with your bank or provider rather than with us, we may suspend your account while it is investigated, and we may withhold a prize paid for with the disputed payment. Please contact us first — a payment we can look up is usually resolved faster than a chargeback.

Acceptable use

Do not use automation, scripts or bots to interact with the service. Do not attempt to discover, infer or interfere with other participants' bids, with the settlement process, or with our payment records. Do not attempt to access another person's account.

Do not use the service for anything unlawful, and do not attempt to resell access to it.

Product descriptions and availability

We describe each product, including its condition, as accurately as we can. Images are illustrative of the model offered.

The service may be unavailable at times for maintenance, or because something has failed. We do not guarantee uninterrupted availability, and we will not take a fee for a bid we cannot accept.

Suspension and closure

We may suspend or close an account for a breach of these terms, for manipulation of the bidding mechanic, for payment fraud, or where we are required to. Where we can, we will tell you why.

A suspended account cannot bid or sign in. Bids already accepted are not removed by a suspension — the power to suspend must never become the power to change who wins an auction.

Deleting your account

You can delete your account at any time from Profile → Delete account. Deletion is immediate and permanent: every session ends, your sign-in methods are removed, and you cannot recover the account.

Some records of completed transactions and of auctions you entered are kept, no longer linked to your phone number or sign-in accounts. If you won a prize, its claim keeps the name and delivery or collection details you gave. If you have paid for a prize that has not yet been delivered or collected, deleting your account does not cancel it, and we still deliver it or hold it for collection. A prize you won but have not paid for is forfeited. Account & Data Deletion explains exactly what is kept and why.

Our intellectual property

The Moii name, logo, app and its content belong to us or our licensors. You may use the app to take part in auctions; you may not copy, resell or reverse engineer it.

Liability

We are responsible for loss we cause by failing to provide the service with reasonable care and skill. We are not responsible for loss that was not reasonably foreseeable, or for loss caused by something outside our reasonable control.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability under mandatory Ethiopian consumer law.

Events outside our control

We are not in breach of these terms if we cannot perform because of something outside our reasonable control — including network or power failure, payment provider outage, or action by a public authority. Where such an event affects a running auction we will act to restore the fair position, including by refunding fees.

Changes

We may change these terms as the product changes. Each change produces a new version with a new effective date, shown at the top of this document. Continuing to use the service after a change means you accept the new version.

Governing law and disputes

These terms are governed by the laws of the Federal Democratic Republic of Ethiopia, and disputes are subject to the jurisdiction of the Ethiopian courts.

There is no arbitration clause and no waiver of your right to bring a claim. Please contact us first; we would rather find the record than argue about it. You may also complain to a competent Ethiopian authority.

If part of this is unenforceable

If any part of these terms is found unenforceable, the rest continues to apply.
